What is a limited common element in a condo?

A limited common element is a piece of the common property reserved for the exclusive use of one unit or a small group of units — most often a balcony, patio, assigned parking space, assigned storage locker, and frequently the unit's exterior door, its windows and the pad the HVAC condenser sits on. It is the middle category in a three-way split that every condo buyer has to understand. Your unit is what you own outright, commonly the space and finishes inboard of the unfinished surfaces of the walls, floors and ceilings — the "paint-in" boundary. Common elements are everything else: roof, structure, lobbies, hallways, grounds, common lighting. A limited common element is legally part of the common elements but yours alone to use. The nuance that decides money: maintenance, repair and replacement of a limited common element is usually the association's responsibility, except to the extent the declaration shifts that duty to the unit owner. The default is association responsibility, and declarations very commonly reassign some or all of it. That means there is no general answer to "who fixes my balcony" — only that unit's declaration decides, and it is the document you have to read. The practical consequence is stranger than it sounds: a balcony can be yours to use, the association's to maintain, and yours to pay for through a special assessment, all at the same time. Which is why a deteriorating balcony guard or a rotted deck ledger matters to you no matter how the declaration allocates it — it comes out of the reserve fund or out of your pocket, and either way it is your exposure. These allocations are governed by state statute and by the individual declaration: Minnesota's Common Interest Ownership Act is Minnesota Statutes chapter 515B, and Iowa's condominium statute is Iowa Code chapter 499B. An inspector reports condition. Only the governing documents assign the bill, and an attorney is the right person to read them.
